June 5, 2018 - Brevard Grand Jury Indicts Palm Bay Teen For Attempted 1st Degree Premeditated Murder

Today (June 5th) the Brevard County Grand Jury indicted EDUARDO J. RIOS (13) of 2910 Eldron Blvd SE Palm Bay, FL with one count of Attempted First Degree Felony Murder Reclassified (LF), one (1) count of Burglary of a Dwelling with Assault or Battery (F1-PBL), two (2) counts of Attempted First Degree Premeditated Murder Reclassified (LF), and one (1) count of Shooting into a Building or Vehicle (F2).

This indictment moves the prosecution of RIOS for these offenses from the juvenile system into the adult criminal court.

On May 19th, 2018 Palm Bay Police arrested RIOS after he forcibly entered a home at 1497 Rila Street SE and used a firearm to shoot at three (3) teens, striking and wounding two of them. The incident is thought to have been the result of a conflict between RIOS and one or more of the victims in the home.

The Grand Jury heard testimony from four (4) civilian witnesses along with Palm Bay Police Department Crime Scene and Criminal Investigators, before returning with the indictment.

RIOS will be transfered from the Juvenile Justice Center to the Brevard County Jail where he's scheduled* for a first appearance on Wednesday June 6th, 2018 at 1:30 pm.

 

*Defendant's may have first appearance waived by the Court without notice.
