January 28, 2019 - First Degree Murder Fugitive Captured in Volusia County

Yesterday (Jan 27) fugitive AUSTIN GARRETT SMILEY (40) was arrested on a warrant for First-Degree Murder by Unlawful Distribution of a Controlled Substance in connection with the 2018 death of Jon Wiggins, II (46). In addition to the outstanding murder warrant, deputies also charged SMILEY with Possession of Methamphetamine, Cocaine, and Drug Paraphernalia.

On January 13, 2018 Seminole County Sheriff's Office Investigators responded to 425 Summit Ridge Place #109, Longwood, where Jon Wiggins II (46) was found deceased. The medical examiner later determined Wiggins had died from an overdose of Fentanyl. A subsequent investigation identified SMILEY as the person who had sold the heroin to Wiggins, and a second overdose victim who survived.

On September 11, 2018 a Seminole County Grand Jury heard testimony from the Volusia County Medical Examiner and a Seminole County Investigator before returning the indictment for First Degree Murder. SMILEY fled to avoid facing prosecution and had remained a fugitive until his arrest last night.

SMILEY is being held on No Bond at the Volusia County Jail. No date has been set for his trial or expected return to Seminole County.
