Yesterday (Sept 21), a Brevard Jury found Dustin JONES (44) guilty of Possession of a Firearm by a Convicted Felon (F2), Assault (M2), and acquitted him on one count of Extortion in connection to a 2019 domestic violence attack on his live-in girlfriend. In a *bifurcated Felony Battery count (F3), JONES entered a plea of Guilty to the Court after learning the jury's verdict. 

 

Judge Lisa Davidson presided over the six (6) day trial with evidence presented by Assistant State Attorneys Clarissa Harrell and Nicole Hosey. JONES was released on his own recognizance pending sentencing that is set for November 24, 2021, 1:15 pm at the Moore Justice Center in Viera.

 

JONES is facing a maximum combined sentence of twenty (20) years - Fifteen (15) years for the Possession of a Firearm by Convicted Felon, five (5) years for the Felony Battery, and up to sixty (60) days for Assault.

 

On January 26, 2019, Brevard County Deputies responded to a domestic dispute between JONES and his live-in girlfriend. They reported that the argument became physical with JONES punching the victim in the head, kicking her, and threatening her with a shotgun. When a witness called 9-11, JONES fled on foot. However, he later returned and again attacked the victim. Criminal history records showed that JONES had previously been convicted of two prior felonies, and was not legally allowed to posses a firearm. He was arrested and later released on bond.

 

*Felony battery is proven by prior criminal history and supporting evidence could not be presented to the jury prior to rendering a verdict on the other charges.
