December 15, 2008 Brevard County Grand Jury Indicts Three Men In November Home Invasion, Shooting

A Brevard County Grand Jury indicted three Palm Bay men for their roles in a Nov. 13 Melbourne home-invasion robbery that killed 50-year-old James E. MacMillen.

The grand jury heard from two lay witnesses and a Melbourne Police Department crime scene technician and detective before returning with a two-count indictment charging the three men with first-degree felony murder and home-invasion robbery while inflicting death. Charged were Kevin M. Rowland, 33, and John Christopher Ellis, 25, both of 425 Tewksbury Lane and Kevin Joseph, 23, 3042 Garden Terrace.

Ellis and Rowland were arrested by Melbourne Police shortly after the shooting near the home at 2014 Bryan Street and Joseph was arrested on Dec. 6.

All three men are scheduled for a first appearance on the indicted charges tomorrow at the Brevard County Jail, said Assistant State Attorney Michael Hunt.
