A former Cocoa Police officer who threatened to shoot a woman in his home and engaged Brevard sheriff’s deputies in an armed standoff has been sentenced to seven years in prison.
PATRICK M. KELLY, 41, pleaded no-contest and was sentenced Feb. 3 on three charges: kidnapping, resisting an officer with violence, and battery-domestic violence.
Assistant State Attorneys Mitchell Ruark and Dave Whateley secured the conviction after reaching a plea agreement with KELLY that also was acceptable to his victim.
KELLY was arrested Dec. 29, 2022, after sheriff’s deputies responded to a report of a domestic disturbance on Framura Lane in Viera. The victim said KELLY was angry when he got home from work, started drinking, grew angrier, then began pulling pistols, rifles and ammunition from a safe.
KELLY threatened to kill the woman and to shoot any deputies who came to the house, sheriff’s reports say. The victim escaped before Kelly fired multiple shots through windows and the roof of the home to “scare off” deputies.
After several hours, KELLY surrendered to the sheriff’s SWAT team and negotiator. Neither the victim nor deputies were struck by gunfire in the incident.
After prison, KELLY will spend two years under house arrest with electronic GPS monitoring followed by six years of supervised probation. During his state supervision, Kelly must stay out of Brevard and Indian River counties. He will receive credit for 767 days served while awaiting trial in the Seminole County jail.
Ruark said the prosecution team worked closely with the victim in this case, “and her strong communication and self-advocacy were instrumental in obtaining a just resolution.”
