December 24, 2007 Sentencing Set in DUI Manslaughter Case

Prosecutors will ask a judge to impose a life prison term for Walter Whynot when he is sentenced on March 7. Whynot was found guilty earlier this week of two counts of DUI manslaughter.

Whynot, 29, of Vero Beach, was also found guilty of DUI with serious bodily injury during the single car accident. The nearly three-week long trial focused on the events of Nov. 20, 2003 when Whynot was driving with three passengers on State Road A1A near the intersection of State Road 520.

According to trial testimony, Whynot attempted to make a U-turn while traveling at 73 miles-per-hour in a 35 mile-per-hour zone, lost control of the car, hit a median and two trees, and rolled the car. Karen Klucinec, 21, of Vero Beach, and Tiffany Watts, also 21 and from Vero, both died at the scene of the accident. Another young woman was severely injured but survived and testified during the trial.

Assistant State Attorneys Sue Garrett and Don Loughran put on testimony from 29 witnesses and introduced 37 pieces of evidence from the crime scene which ranged the distance of a football field. The jury heard from both survivors of the crash—the defendant and victim Sarah Ringlund.

The prosecutors said the state will ask Circuit Court Lisa Davidson to send Whynot to prison for life during the 1:30 p.m. sentencing.
