February 5, 2007 Brevard State Attorney's Office Files Charges Against One; Investigation Continues

Prosecutors have filed two counts of Open House Party, a second-degree misdemeanor, against Caleb McKinney, 18, of Port St. John. The charges are in connection with two parties sponsored by McKinney at which underage individuals were drinking alcohol.

Titusville teens, Chelsea Beck and Morgan Gordon, attended one of the parties before they died in a fatal, single car accident on September 17.

State Attorney Norm Wolfinger said the investigation into how the alcohol was obtained and by whom is continuing.

The maximum penalty for a second-degree misdemeanor is 60 days in the Brevard County Jail, up to 12 months probation, and a fine of $500. McKinney is scheduled to be in court February 27 before Brevard County Judge Oscar Hotusing at 9:30 a.m. for arraignment.
