Worthless Check Diversion Program

Once our office receives your worthless check affidavit, we may offer the check writer an alternative to prosecution.

The alternative would require the offender to enter a diversion program. They will sign an agreement requiring payment of restitution in full, plus payment of the service charge to the victim, as well as a fee for the program. The offender is also required to attend a financial responsibility course. By offering this diversion alternative to an offender, victims may receive restitution sooner.

Although the time necessary to process a worthless check complaint varies from case to case. The total time from the initial receipt of your complaint to the time the filing decision is made could be from 5 to 8 months.

If the check writer elects not to participate in the diversion program, or elects to participate and then violates the diversion agreement, our office will then make a criminal filing decision.
