Worthless Check Diversion Program

Once our office receives your worthless check affidavit, we may offer the check writer an alternative to prosecution.

The alternative would require the offender to make payment directly to the victim within 60 days of the filing of the case. Once payment has been made, a copy of the payment receipt must be provided to the Office of the State Attorney. By offering this diversion alternative to an offender, victims may receive restitution sooner.

Although the time necessary to process a worthless check complaint varies from case to case, the total time from the initial receipt of your complaint to the time the filing decision is made could be from 5 to 8 months.

If the check writer elects not to make payment to the victim within the 60 days, our office will then make a criminal filing decision.
