February 4, 2008 Brevard County Grand Jurty Indicts Three Men, Hassan Elijas Scott, Dwan Smith, and Anthony Horsley, Jr., in the 2006 Murder of Palm Bay Store Clerk

The Brevard County Grand Jury returned three first-degree murder charges on Tuesday, January 29, 2008, in connection with the fatal June 11, 2006, shooting of Kiran “Ken” Patel, owner of The Beverage Store in Palm Bay.

The indictments charge the following individuals with first-degree felony murder, robbery with a firearm, and two counts each of aggravated assault with a firearm: Hassan Elijas Scott, 21, 885 Evergreen Place, Rockledge; Anthony Horsley, Jr., 18, Brevard County Juvenile Detention Center; and, Dwan Smith, 17, 417 Rosa L. Jones Blvd., Cocoa.

Testifying before the Grand Jury on Tuesday were two witnesses: a Palm Bay police detective and a lay witness who was also a victim of an aggravated assault.

The three men have been in custody since their arrests by Palm Bay Police on January 9 and 10 this year. They are scheduled for a first appearance on the revised charges Wednesday, January 30th, at the Brevard County Jail.
