Sealing/Expunging Instructions

The following information has been put together to assist in answering questions on requirements to have your case sealed or expunged in Brevard County.

You will need the seal/expunge packet which can be downloaded from the Brevard County Clerk of Court’s website at (www.Brevardclerk.us) or from the Florida Department of Law Enforcement’s website at www.fdle.state.fl.us/Seal-and-Expunge-Process/Seal-and-Expunge-Home.aspx.  You can also call FDLE’s Expunge Section in Tallahassee at 850-410-7870 and request the forms, instructions and how to complete and submit the form and a fingerprint form.

When you have obtained the Application for Certification of Eligibility, you will need to fill all of “Section A” out, and then have it notarized.  You will then need to send the application along with a self addressed stamped envelope to the State Attorney’s Office, 2725 Judge Fran Jamieson Way, Building D, Viera, Fl. 32940, for “Section B” to be completed.  Once “Section B” is completed, the application will be mailed back to you.  You will then need to follow the instructions from the information packet you printed or were mailed.

See section 943.0585, Florida Statutes, for expunctions and section 943.059, Florida Statutes, for sealings.
