September 2, 2015 State Attorney files notice of "No Information" in Sexual Battery case against Vero Beach Attorney Charles Sullivan

The 18th Circuit State Attorney's Office has filed a "Notice of No Information" today in the alleged sexual battery case against attorney Charles Sullivan Sr., Vero Beach. Sullivan was arrested June 25 following a Vero Beach Police Department investigation of a complaint.

 

Because of Sullivan's connection to the legal community in Indian River County, Indian River State Attorney Bruce Colton requested an executive assignment through the governor's office, ensuring that an independent review of the potential charges would occur and that any prosecution, if initiated, would be free from previous interaction with the defendant. The 18th Circuit was assigned and Brevard State Attorney Phil Archer designated Assistant State Attorney Julia Lynch as the lead on the case. Lynch is the Division Chief of the 18th's Child and Sexual Abuse prosecution unit.

 

After a lengthy investigation involving several trips to Vero Beach to meet with the victim, her representatives, law enforcement, and others, Lynch filed the no information today, absolving Sullivan from prosecution in the case.

 

"These cases are difficult, not only for the victim, but for everyone involved because the goal is to be certain the correct and just decision is made.  The Vero Beach Police Department has been excellent to work with and has diligently pursued all issues raised. There was probable cause for the arrest, however, it is our decision taking into consideration all information that might be presented at trial that there would be no likelihood of conviction on this charge," Lynch said.
