- Pallante Motion For New Trial Denied. Court Rules No Juror or Prosecutorial Misconduct
Today Judge David Dugan issued an Order Denying the motion for new trial by attorneys for Defendant Joseph Pallante III.
On October 11, 2017 a jury found PALLANTE guilty of multiple counts of Sexual Battery on a Child under 12, Sexual Battery by a Person with Familial Custody, and felony counts that included Lewd and Lascivious Molestation, and Possession of Child Pornography.
Shortly after the verdict attorneys for PALLANTE filed a Motion for New Trial and Motion for Jury Inquiry alleging "bad faith" in the actions of prosecutors who presented evidence in the trial and that misconduct by deputies had impacted the deliberations of the jury.
Both arguments were dismissed in Judge Dugan's written Order and PALLANTE will be sentenced on November 13th, 2017 at 10:30 AM.
