A Notice of No Information has been filed in the matter of John Horan (65) arrested April 25, 2018 and charged with Battery – Domestic Violence by Winter Springs Police.

Every criminal complaint that our office receives undergoes a careful and thorough review by experienced prosecutors to determine if they reasonably believe the alleged crimes can be proven beyond a reasonable doubt at trial. When that process finds the required evidence is not sufficient, prosecutors are ethically and legally obligated not to pursue prosecution of the defendant.

In this case, conflicting accounts of the incident combined with minor injuries sustained by both parties in an admitted mutual exchange of blows, resulted in a lack of evidence to support a probable conviction. The difficulty was further compounded by the victim’s written declination of prosecution filed just days after the arrest.
