December 18, 2019 - Markice HARVEY Receives Two Life Sentences for Murder and Robbery

Yesterday (Dec 17), Judge Robin Lemonidis sentenced Markice HARVEY (26) to Life in Prison on each of his two convictions for First Degree Premeditated Murder with Firearm (CF), and Robbery with a Firearm (F1 PBL) for his role in the death of Dimitric Bailey (22) on July 29, 2018 in Cocoa. The sentences will be served concurrently. After a trial that began Tuesday Dec 10, 2019, HARVEY was convicted by a jury after deliberating just two and a half hours yesterday.
 
Cocoa Police reported that a surveillance camera captured Dimitric Bailey park his car in front of a home in the 1700 Block of Vagabond Street. HARVEY and two other defendants, Kenneth LEVATT (25) and Xavier TURNER (23) then executed a planned robbery and shot Bailey before fleeing the scene. Cocoa Police later found Bailey deceased in his car. All three men were subsequently arrested and held on murder and robbery charges.
 
HARVEY was adjudicated guilty on both counts by Judge Lemonidis, who in addition to the life sentence imposed on the second count of Robbery with a Firearm Causing Death, added the condition HARVEY must serve a minimum mandatory sentence of 25 years in prison, with no gain time, and is ineligible for any form of early release.
 
TURNER was sentenced to two life sentences on October 23, 2019, after being convicted of First Degree Felony Murder and Robbery with a Firearm for his role in Baily's death. LEVATT is still in custody awaiting trial.
 
HARVEY was held in custody at the Brevard County Jail awaiting transfer to the Florida Department of Corrections to begin serving his sentence.
