Today (Jan 16), Circuit Judge Jeffrey Mahl issued an Order denying the Defense Motion to Dismiss pursuant to "Stand Your Ground" Immunity. 

 

In the single page Order, Judge Mahl wrote "The Court having reviewed the file and evidence presented, heard argument of counsel and testimony of witnesses, and being otherwise fully advised in the premises, it is hereby found that the State has met the burden of proving by clear and convincing evidence that the Defendant is not entitled to dismissal of the charges."

 

No date has been set for a trial to begin, and the case is set for Calendar Review on March 4, 2020 at 8:30 am.
