- Kenneth LEVATT JR. Receives Two Life Sentences For 2018 Murder and Robbery
Yesterday (Mar 9), Judge Robin Lemonidis sentenced Kenneth LEVATT JR (26) to Life in Prison on each of his two convictions for First Degree Felony Murder (CF), and Robbery with a Firearm (F1 PBL) for his role in the death of Dimitric Bailey (22) on July 29, 2018, in Cocoa. The sentences will be served concurrently. After a trial that began with two days of jury selection on Monday March 2, 2020, LEVATT JR was convicted by a jury after deliberating four and a half hours yesterday. A charge of Accessory After the Fact was dismissed by the Jury after establishing that LEVATT JR was guilty of First Degree Felony Murder.
Cocoa Police reported that a surveillance camera captured Dimitric Bailey park his car in front of a home in the 1700 Block of Vagabond Street. Kenneth LEVATT JR (26), and two other defendants, Markice HARVEY (27) and Xavier TURNER (24) then executed a planned robbery and shot Bailey before fleeing the scene. Cocoa Police later found Bailey deceased in his car. All three men were subsequently arrested and held on murder and robbery charges.
LEVATT JR was the third and final defendant to be convicted in this murder and will be transferred to the Department of Corrections to begin serving his sentence.
TURNER was sentenced to two life sentences on October 23, 2019, after being convicted of First Degree Felony Murder and Robbery with a Firearm.
HARVEY was sentenced to two life sentences on December 17, 2019, after being convicted of First Degree Premeditated Murder with Firearm and Robbery with a Firearm. In addition HARVEY must serve a minimum mandatory sentence of 25 years in prison, with no gain time, and is ineligible for any form of early release.
