March 2, 2021 - Brevard Grand Jury Indicts Toby GAMBLE and Hunter OSWIECINSKI for Murder

Today (Mar 2), the Brevard County Grand Jury issued murder indictments for two defendants in the shooting death of Tyler Anthony McCoullough (33), on Forrest Knoll Drive in Palm Bay on December 24, 2020.

Toby GAMBLE (23) was indicted for First Degree Premeditated Murder with a Firearm (CF), and Possession of a Firearm by a Convicted Felon (F2). The second defendant, Hunter OSWIECINSKI (17), was indicted for First Degree Premeditated Murder (CF), and Possession of a Firearm by a Delinquent (F2).

Just before 4:00 a.m., Palm Bay Police responded to reports of gun shots in the area of Forrest Knoll Drive and NE Tree Ridge Lane. There they found McCoullough on the ground having suffered multiple gunshot wounds. He was transported to the hospital but later died of his injuries.

A months long investigation identified GAMBLE and OSWIECINSKI as having shot McCoullough, in an apparent response to a verbal dispute that had taken place at a convenience store a short time earlier. OSWIECINSKI was arrested on a Take Into Custody Order February 5, 2021, and GAMBLE was arrested on a warrant the following day February 6, 2021. Both were held on No Bond. OSWIECINSKI has been charged as an adult and will be moved from Juvenile Detention to the Brevard County Jail.

No trial date has been set in this case. Please consult the Brevard Clerk of Courts website for updates on future court appearances by these defendants.
