Wednesday (Oct 27), Circuit Judge Tesha Ballou sentenced Jarvis KELLY (25), to twelve (12) years in state prison after a Brevard jury convicted him on one (1) count of Sale of Controlled Substance within 1000' of Public Housing (F1), two (2) counts of Possession of Fentanyl (F3). Judge Ballou sentenced KELLY to twelve (12) years for the Sale of Controlled Substance, five (5) years for each of the Fentanyl counts, and sixty (60) days for Failure to Appear, all to be served concurrently. KELLY was given credit for 255 days already served.

 

In a trial that lasted three (3) days, Assistant State Attorneys Bryon Aven and Shane Williams presented evidence to the jury who deliberated about 3 hours before returning with the guilty verdicts.

 

KELLY was arrested on October 2, 2020, after the Titusville Police Department's Special Investigations Section was able to purchase Fentanyl from him within 1000' of a public housing facility located on South Brown Avenue. When taken into custody, KELLY was found in possession of additional fentanyl. While the case was being prepared for trial, KELLY failed to appear as required on July 12, 2021, with Judge Ballou issuing a warrant for his arrest. KELLY was taken into custody on August 12, 2021, and has remained in custody since.

 

KELLY will continue to be held on No Bond and is currently facing charges of Possession of Cocaine, Possession of a Firearm by Convicted Felon, and Failure to Register as a Sex Offender in three (3) pending cases.
