February 14, 2024 - Rocky RUDOLPH Sentenced to 30 Years in State Prison

Today (Feb 14), Circuit Judge Melanie Chase sentenced Rocky RUDOLPH (42), to thirty (30) years in prison after a Seminole County Jury convicted him on January 24, 2024, in the Attempted Manslaughter and Aggravated Battery of a law enforcement officer after he fled from a traffic stop on June 29, 2019.

Prior to imposing the sentence, RUDOLPH told Judge Chase that he wanted to apologize for his "unintentional" actions that led to his conviction. RUDOLPH's Assistant Public Defender Michael Schoenberg pointed to that remorse and asked for the minimum possible prison sentence.

Assistant State Attorney Gino Feliciani presented several exhibits establishing that RUDOLPH's prior felony convictions qualified him for enhanced sentencing as a Habitual Felony Offender. ASA Feliciani also explained that RUDOLPH's criminal history went back more than 20 years, beginning when he was a juvenile. Further that RUDOLPH had previously been sentenced to prison for committing two of the offenses he was convicted of again in this case, fleeing from law enforcement and possession of a firearm by a convicted felon. A minimum sentence of 30 years to a maximum of life in prison was requested by ASA Feliciani.

Judge Chase sentenced RUDOLPH as a habitual felony offender to 5 years for Attempted Manslaughter (F3), 30 years for Aggravated Battery Upon a Law Enforcement Officer (F1), 15 years for Possession of Firearm by Convicted Felon (F2), 364 days for Resisting an Officer Without Violence (M1), 5 years for Fleeing Attempting to Elude (F3), 5 years for Attempting to Deprive Officer of Protection Communication (F3), and 364 days for Possession of Cannabis (M1).

The sentences will be served concurrently with credit for 1691 days for time served. RUDOLPH was also ordered to pay $7200 in restitution to the victim.
